After being placed in an illegal choke hold by an NYPD officer who has already been sued, costing taxpayers $30k, NYPD and NY EMS failed to attempt to revive Eric Garner. In New York, there is a duty of care owed by public safety personnel. Here, the NYPD and the EMS failed to provide any medical assistance. They had Eric Garner in their custody. They owed duty of care to Eric Garner. They breached this duty and thus are negligent.
Let’s see how much the jury awards Mr. Garner’s family.
